- IMPORTANT NOTICE
- These Terms & Conditions (“Terms”) govern your access to and use of our hosting and related services. By ordering, paying for, or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. These Terms also include our Scope of Support and Fair‑Use Policy. Our privacy policy is outlined here.
- 1. Definitions
- “We”, “us”, “our”, or “Provider” refers to The Perfect Era for Technology Company (شركة الحقبة المثالية للتكنولوجيا).
- “You” or “Customer” refers to the individual or entity purchasing or using the Services.
- “Services” refers to the hosting, management, migration, and related add‑on services described in the applicable Order Form and Pricing Page.
- “Managed WordPress” refers to the bundled hosting and care service described in Section 7.
- “Standard Hosting” refers to the self‑managed hosting service described in Section 7.
- “Order Form” refers to any online checkout, quotation, or written order referencing these Terms.
- “AUP” refers to our Acceptable Use Policy detailed in Section 10.
- 2. Agreement Structure

- 3. Services
- We will provision the Services after receiving payment and will provide onboarding instructions. Migrations, where included, require complete and accurate credentials.
- We may implement routine improvements, maintenance, or upgrades without notice. Material changes that reduce functionality will be communicated when reasonably feasible.
- Certain features (e.g., CDN, WAF, email) may be delivered through trusted third-party providers, whose terms may apply to you.
- 4. Accounts & Customer Content
- You are responsible for all activities conducted under your account and for maintaining secure passwords and access control.
- You retain full ownership of your content. You grant us a limited license to host, back up, and process your content as necessary to provide the Services.
- You are solely responsible for complying with all applicable laws relating to your content, including intellectual property, privacy, and data protection requirements.
- 5. Fees, Billing & Taxes
- Fees are those listed on the Pricing Page or stated in your Order Form. Fees are in USD unless otherwise noted and are non-refundable except as required by law or expressly stated.
- Subscriptions renew automatically at current rates unless canceled before the renewal date.
- Overage fees may apply as outlined in Section 8. We will provide prior notice of any sustained overage.
- You are responsible for all applicable taxes, duties, and levies, excluding taxes based on our net income.
- 6. Term, Suspension & Termination
- The Term begins upon activation and continues for the duration of the subscription. Either party may terminate for convenience at the end of the current billing term unless a fixed term applies.
- We may suspend Services immediately for:
- non-payment;
- security risks;
- AUP violations;
- law enforcement requests;
- to prevent harm to the platform or others.
- Upon termination, backups are retained according to plan retention. We will make reasonable efforts to assist with data export, but you are responsible for maintaining your own independent backups.
- 7. Scope of Support (Managed vs. Standard)
- Included in All Plans
- Server uptime monitoring and incident response consistent with plan SLA.
- DNS guidance and verification for domains hosted with us.
- SSL certificate installation and renewal (Let’s Encrypt or equivalent).
- Daily automated backups according to plan retention.
- Platform‑level security management, firewall configuration, and malware scanning.
- Resource usage monitoring (storage, bandwidth, visits).
- Managed WordPress (Care Included)
- WordPress core, plugin, and theme updates (frequency per plan).
- Security hardening and vulnerability patching.
- Performance optimization, caching configuration, and CDN setup.
- Uptime monitoring and site health checks.
- Staging environments (quantity per plan).
- Maintenance reports (weekly or monthly).
- Minor content adjustments within the included monthly allowance.
- Issue diagnosis and troubleshooting within the Care allowance.
- Standard Web Hosting (Self‑Managed)
- Application‑level work (e.g., CMS/plugin troubleshooting) is not included. You may purchase add‑ons or upgrade to a Managed WordPress plan for hands‑on support.
- Exclusions (Out‑of‑Scope)
- Custom development or plugin creation.
- Resolving issues caused by unsupported, nulled, or compromised plugins/themes.
- Major content revisions or structural site changes.
- Support for unrelated third‑party services (CRM, email marketing, ERP, etc.).
- Manual malware cleanup (available as a paid add‑on).
- Troubleshooting non‑WordPress CMS platforms under Standard Hosting.
- Included in All Plans
- 8. Fair‑Use & Overage Policy
- We operate under a soft fair‑use model. We monitor sustained overage and will contact you before applying charges.
- Storage: Overages billed at $0.50/GB/month.
- Visits/Bandwidth: After ~2 consecutive months of sustained overage, a fee of $10 per additional 50,000 visits/month may apply, or a plan upgrade may be recommended.
- Prohibited workloads: Excessive or abusive workloads (e.g., crypto mining, stress testing, bulk email) may trigger suspension or require an upgrade.
- Out‑of‑scope debugging: Available at $120/hour (0.5‑hour minimum).
- We operate under a soft fair‑use model. We monitor sustained overage and will contact you before applying charges.
- 9. Service Levels & Maintenance
- We target the following first‑response SLAs during business hours:
- Standard: 48–72 hours
- Managed Starter: 48 hours
- Managed Growth: 24 hours
- Managed Pro: 8 hours
- Business: 4 hours
- Emergency cases for Pro/Business are prioritized. Planned maintenance may occur during low‑traffic windows and will be announced when feasible.
- We target the following first‑response SLAs during business hours:
- 10. Acceptable Use Policy (AUP)
- You may not use the Services to:
- Violate applicable law or third‑party rights (including IP and data protection).
- Send spam or unsolicited bulk email, or host spam tools.
- Host malware, phishing content, or engage in disruptive/harmful activities.
- Conduct resource‑abusive workloads (e.g., crypto mining, DDoS tools).
- Host sexually explicit content or any form of obscene or indecent material.
- We may remove content or suspend Services for AUP violations. Repeated or severe violations may result in termination.
- You may not use the Services to:
- 11. Security & Backups
- We implement commercially reasonable security measures and perform routine backups according to plan retention. No system can guarantee perfect security or error-free backups; therefore, you must maintain your own independent backups.
- 12. Data Protection & Privacy
- We process limited personal data necessary to operate the Services as described in our Privacy Notice. You act as the controller of personal data contained within your websites and must provide appropriate notices and obtain any required consents.
- Data may be processed in data centers outside your country in accordance with applicable law.
- 13. Third‑Party Services
- Certain Services may interoperate with third‑party tools (e.g., DNS, email, analytics, CDN). We are not responsible for those third‑party services or changes to their availability, functionality, or pricing. Their terms may apply to your use.
- 14. Intellectual Property
- We retain all rights to our platform, configurations, and materials. You retain ownership of your content. Except for the limited license required to operate the Services, no other rights or licenses are granted.
- 15. Disclaimers
- THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
- UPTIME TARGETS ARE GOALS ONLY AND NOT GUARANTEES, UNLESS YOUR ORDER FORM INCLUDES AN EXPRESS SLA WITH CREDITS.
- 16. Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY.
- OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS IN ANY 12‑MONTH PERIOD WILL NOT EXCEED THE FEES PAID BY YOU FOR THE SERVICES DURING THAT PERIOD.
- 17. Indemnification
- You agree to defend, indemnify, and hold us harmless against any claims arising out of your content, your use of the Services in violation of these Terms, or your breach of applicable law or third‑party rights.
- 18. Changes to Terms
- We may update these Terms periodically. Material changes will be communicated by email or via the account portal. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
- 19. Notices
- Notices to you may be provided by email or through the account portal. Notices to us must be sent to the Contact Email listed above, with a copy to the Registered Address.
- 20. General Provisions
- Entire Agreement: These Terms, together with the Order Form and incorporated policies, constitute the entire agreement between the parties.
- Severability: If any provision is deemed unenforceable, the remaining provisions remain in effect.
- No Waiver: Failure to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign these Terms without our prior consent. We may assign them to an affiliate or as part of a merger or sale.
- Force Majeure: Neither party is liable for delays caused by circumstances beyond reasonable control.
- Relationship: The parties are independent contractors and no agency or partnership is created.
